Visa 132 - Business Talent

 

This visa is available for high-calibre business people who have a genuine commitment to operate a business in Australia.

 

Significant Business History Stream

This visa provides permanent residence status at the first stage. You must be nominated by the Government of Western Australia to apply for this visa. State Nomination criteria includes:

  • You have maintained at least a 30 per cent ownership share (or 10 per cent where the business is a publicly listed company) and directly managed a business which had turnover of at least A$3,000,000 for two of the last four fiscal years;

  • Your net assets in business were at least A$400,000 for two of the last four fiscal years;

  • You are able to transfer at least A$3,000,000 to Western Australia within two years of visa grant for your business investment and settlement costs;

  • Your proposed business activity will generate substantial economic benefits for the State of Western Australia (refer to the State nomination guidelines); and

  • You are less than 55 years of age, or you are proposing to participate in a business activity which will be of exceptional economic benefit to the State (refer to the State nomination guidelines).

 

Venture Capital Stream

  • You have entered into a legally enforceable agreement with an Australian company to receive venture capital funding for:

    • the early-phase start-up of a business; or

    • the commercialisation of a product; or

    • the development of a business; or

    • the expansion of a business.

  • You have sourced at least A$1,000,000 in venture capital funding through a member of the Australia Venture Capital Association Limited (AVCAL);

  • You have access to an additional A$50,000 for settlement and ongoing living costs;

  • Your proposed business activity will generate substantial economic benefits for the State of Western Australia (refer to the State Sponsorship Guidelines); and

  • You are less than 55 years of age, or you are proposing to participate in a business or investment activity which will be of exceptional economic benefit to the State (refer to the State Sponsorship Guidelines)

Business Innovation Stream

 

This visa is available for holders of the 188 Business Innovation and Investment - Business Innovation Stream visa.

 

State nomination criteria

Western Australian State nomination criteria includes:

  • You were the primary visa applicant, and met the primary criteria for the grant of your provisional Business Innovation and Investment visa;

  • You have owned and managed up to two actively trading businesses in Western Australia during the last 24 months*;

  • Unless the Government of Western Australia has determined that there are exceptional circumstances, your business(es) had turnover of at least A$300,000 during the last 12 months; and

  • Unless the Government of Western Australia has approved a change to your business proposal, you must have met the conditions of the State Nomination Agreement of your provisional business visa, including:

    • Total capital transfer to WA

    • Business investment

    • Type of business activity

    • Location of business activity

    • Employment generation

 

*If you acquired the ownership interest of your business(es) from another person who was an applicant for, or held, a Business Skills (Permanent) (Class EC) visa at the time of the acquisition, you must have held the ownership interest with that person as a joint interest for at least one year before you make your permanent application;

Investor Stream

 

This visa is available for holders of the 188 Business Innovation and Investment – Investor Stream visa.

 

State nomination criteria

Western Australian State nomination criteria includes:

  • You were the primary applicant for your 188 Business Innovation and Investment (Provisional) visa;

  • You have held your Designated Investment for at least four years OR your investment is due to mature within the next three months;

  • You have been resident in Australia for a total of at least two years during the last four years;

  • You have a genuine and realistic commitment to maintain a business or investment activity in Western Australia; and

  • Unless the Government of Western Australia has approved a change to your business proposal, you must have met the conditions of the State Nomination Agreement of your provisional business visa, including:

    • Total capital transfer to WA

    • Investment in Treasury Bonds
